MotoRadds App — Terms of Service

These terms cover the MotoRadds mobile app. Purchases on our online store are governed by the separate store Terms of Service.

These Terms of Service ("Terms") govern your use of the MotoRadds mobile app (the "Service"), operated by MotoRadds, LLC ("MotoRadds"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Safety first — read this section

Never interact with MotoRadds while operating a motorcycle or vehicle. Set up ride recording before you start, put your phone away or in a secure mount, and interact with the app only when safely stopped. Using a phone while riding is dangerous and illegal in many places.

MotoRadds is a ride logging and social app. It is not a navigation tool, and nothing in the Service is an invitation to ride faster, take risks, or break traffic laws. We deliberately exclude speed statistics from the app because we don't want to encourage dangerous riding. You are solely responsible for riding safely, legally, and within your abilities, for your vehicle's condition, and for complying with all traffic laws, licensing, and insurance requirements where you ride.

Assumption of risk. Motorcycling and driving are inherently dangerous activities. You participate in rides — including group rides organized through the Service — voluntarily and at your own risk. MotoRadds does not organize, supervise, or vouch for any ride or rider, and is not responsible for the conduct of other users, road conditions, or anything that happens on a ride.

2. Your account

You must be at least 16 years old to use the Service. You are responsible for the accuracy of your account information and for everything that happens under your account. One account per person; don't impersonate others or misrepresent your identity. Rider verification badges reflect only that a selfie review was completed and are not an endorsement or identity guarantee.

3. Your content

You retain ownership of the content you post — rides, photos, messages, reviews, and profile information. By posting, you grant MotoRadds a non-exclusive, worldwide, royalty-free license to host, display, and share that content as needed to operate the Service (for example, showing your rides on your profile or your messages to their recipients). You are responsible for your content and must have the rights to share it.

Community rules. Don't use the Service to harass, threaten, or defame others; post illegal, hateful, or sexually explicit content; encourage dangerous or illegal riding; spam or scam other users; or upload content that infringes someone else's rights. We may remove content and suspend or terminate accounts that violate these rules, at our discretion.

4. Location features

Features like ride recording, ride detection, and nearby riders rely on location permissions you control. Sharing your approximate location with other users is part of how the nearby-riders and group ride features work; you can limit visibility in Settings or by disabling location permissions, though some features will stop working.

5. The Service

We work hard to keep MotoRadds running, but the Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that data (including ride logs) will never be lost — keep your own records of anything important. We may modify, suspend, or discontinue features at any time.

6. Limitation of liability

To the maximum extent permitted by law, MotoRadds and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, injury, property damage, or death arising from your use of the Service, your riding, or your interactions with other users. To the extent liability cannot be excluded, our total liability is limited to the greater of (a) the amount you paid us in the twelve months before the claim, or (b) USD $50.

7. Indemnification

You agree to indemnify and hold MotoRadds harmless from claims arising out of your content, your use of the Service, your riding activities, or your violation of these Terms or applicable law.

8. Termination

You can stop using the Service and delete your account at any time in Settings. We may suspend or terminate your account if you violate these Terms or use the Service in a way that could harm other users or MotoRadds. Sections 1, 3, 5, 6, 7, and 9 survive termination.

9. General

These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict-of-laws principles. If any provision is found unenforceable, the rest remain in effect. These Terms, together with the App Privacy Policy, are the entire agreement between you and MotoRadds regarding the Service. We may update these Terms from time to time; material changes will be announced in the app, and continued use after changes means you accept them.
